HOW TO GET STARTED

NEW JERSEY - GROUNDS FOR DIVORCE

IRRECONCILABLE DIFFERENCES

Issues that have caused the breakdown of the marriage for a period of six months or more and which make it appear that the marriage should be dissolved and that there is no reasonable prospect of reconciliation.

SEPARATION - NO FAULT

No-fault grounds for divorce require that the parties have been separate and apart for 18 consecutive months, indicating there is no reasonable prospect of reconciliation

ADULTERY

Grounds of where one spouse has committed adultery.

ABANDONMENT

Ground refers to one spouse leaving the marital home and refusing to return without any viable justification.

EXTREME CRUELTY

Ground is defined as any physical or emotional abuse that endangers the safety or health of a spouse and makes it unreasonable to expect the spouse to continue living with the abusive spouse.

ADDICTION

Alleging that your spouse’s habitual alcohol problem or drug addiction has lasted for at least 12 consecutive months.

INSTITUTIONALIZATION

Institutionalization for mental illness for a period of 24 or more consecutive months subsequent to marriage and next preceding the filing of the complaint;

IMPRISONMENT

Imprisonment of the defendant for 18 or more consecutive months after marriage, provided that where the action is not commenced until after the defendant’s release, the parties have not resumed cohabitation following such imprisonment;
